Dating Service Consumer Bill of Rights

This notice is provided in accordance with New York General Business Law §394-c(e).
New York State Law provides protections for consumers entering into social referral service contracts. A "social referral service" includes any service for a fee providing matching of members, by use of computer or any other means, for the purpose of dating or general social contact. This includes online dating services offered through a mobile application, such as Bloom.
As a New York consumer, you have the following rights:
1. Contract price and duration. No social referral service contract shall require the payment by you, the purchaser, of an amount greater than one thousand dollars ($1,000). No such contract may extend over a period of time greater than two years. Note: For online dating services like Bloom where the initial subscription term is one year or less and any subsequent terms are one year or less, this price cap does not apply (GBL §394-c(2)).
2. No mandatory ancillary services. No social referral service contract shall require you, the purchaser, to purchase a good or service which is directly or indirectly related to the social referral service. While ancillary services may be offered to you, the law prohibits the seller from requiring that you purchase them as a condition of your social referral service contract. Bloom does not require the purchase of any ancillary services.
3. Minimum referrals and cancellation for non-delivery. If your social referral service contract costs more than twenty-five dollars ($25), the seller must furnish a minimum number of referrals per month to you. For online dating services with search functionality, algorithm, or location-based matching (such as Bloom), the requirement is to provide any social referral. If this minimum is not furnished to you for two successive months, you have the option of cancelling the contract and receiving a full refund of all money you paid, less a cancellation fee which cannot exceed either fifteen percent (15%) of the cash price or a pro rata amount for the number of referrals furnished to you, whichever is greater.
4. Distance specifications. Your social referral service contract must specify the distance which you, the purchaser, are willing to travel to meet any social referral. No social referrals shall be furnished where you and the referral live at a distance greater than the distance specified in the contract. In Bloom, you set your preferred distance range in your matching preferences.
5. Relocation policy. The provider must have an established policy to address the situation of your moving outside the area it services. This policy must be explained in your contract. Bloom's relocation policy: If you relocate more than 50 miles from your location at the time of purchase, you may cancel your subscription and receive a pro rata refund of any prepaid fees. Contact support@bloom.date to exercise this right.
6. Right to bring court action. If any provision of the social referral service contract is violated, you have the right to bring a court action against the provider which has violated the contract.
In addition to these rights, New York law requires:
Right to place membership on hold. Every contract must provide each consumer with the unilateral right to place his or her membership on hold for a period of up to one year; provided, however, that the agency and the consumer may mutually agree to a longer period not to exceed two years. To exercise this right, notify Bloom in writing at support@bloom.date.
Three-business-day right to cancel. You may cancel your contract without any cancellation fee within three (3) business days after the date of your contract. Cancellation must be made in writing and must be delivered by certified or registered U.S. mail or email to:

If you cancel, any payments made by you under the contract will be returned within ten (10) business days following receipt by Bloom of your cancellation notice.
Return of personal materials. At the expiration of the contract or at the expiration of services rendered by Bloom, for any reason, all information and material of a personal or private nature acquired from you will be available for download through your account or returned to you upon request. Contact support@bloom.date to request your data.
Fraud ban notifications. If Bloom bans a member for fraud, Bloom will notify New York members who communicated with the banned member, including the banned member's username or account identifier and the reasons for the ban.
